DLA Piper Held Not Guilty of Sex Discrimination by Tribunal

Recently, an Employment Tribunal has held that law firm DLA Piper was not guilty of sex discrimination in removing Sarah Sweeney, a former real estate partner at the firm.

According to a report by the Liverpool Echo, Sarah was removed in November, 2008 when she was three months pregnant. The termination letter came a few days after she informed the Liverpool real estate head Mark Beardwood of her pregnancy. She believed it to be due to her pregnancy and therefore filed a case of unfair dismissal on the ground of sex discrimination.

According to her complaint, she was told that women with children should not work and that her bottom was slapped. However, her complaint was dismissed on the evidence that the firm had removed her on completely different ground that had nothing to do with pregnancy. She does not seek to appeal the decision.

According to Judge Reed, the firm produced documents to show that her removal was being discussed for a while before she even mentioned her pregnancy. While it does look discriminatory on the surface, it was not the reason for her removal.

According to a spokesman for the firm, DLA Piper is happy with the judgment but regrets that this case was filed in spite of it being baseless. He said that the firm always had documentary evidence and that its former employee’s alleged discrimination charge on the basis of sex was not true. The firm said that it had taken the right decision and is happy with the tribunal’s support of the same.
